SJC Dismisses Misconduct Complaint Against IHC Judge Over Son’s Hit-and-Run Case

The Supreme Judicial Council (SJC) has dismissed a complaint filed against Islamabad High Court (IHC) Justice Muhammad Asif, ending proceedings linked to a fatal road accident involving his son. The complaint was rejected during the SJC’s meeting held on June 22, and the council formally notified the complainant, retired Colonel Inam ur Rahim, of its decision.

The case goes back to last December, when a black SUV travelling at high speed, allegedly driven by Justice Asif’s son, hit two girls riding a scooter near the Pakistan National Council of Arts in Islamabad, and both girls died in the collision. A judicial magistrate later ordered the son’s release on bail on December 6, 2025, after the victims’ families pardoned him in court under the qisas and diyat provisions of the Pakistan Penal Code.

Following this, lawyer Colonel (Retd) Inam-ur-Rahim filed a complaint accusing Justice Asif of serious misconduct, alleging that he used his influence and state machinery to pressure the victims’ families into forgiving his son. The complaint also claimed the son was driving without proper customs clearance for the vehicle at the time of the crash.

After reviewing the matter, the council decided to dismiss the complaint, and no further action has been announced against the judge. The council has not publicly shared the detailed reasons for its decision.

The SJC is the constitutional forum responsible for examining the conduct of superior court judges and can recommend removal to the president if misconduct is proven. With this dismissal, the matter is now considered closed before the council.
